Human Rights ruling rejects policy restricting families to main floor apartments – Yahoo! Canada News

BRANDON, Man. – The Manitoba Human Rights Commission has ordered a management company in Brandon to remove its restrictions on renting only ground floor apartments to families with children.
Wendy Hiebert, a mother with a five-year-old son, has been awarded $1,000 after filing a complaint in 2007 against Martin-Liberty Realty Ltd.
Hiebert was told by an official with the realty company that because of noise and safety concerns, families with children were only allowed to rent ground floor units.
No apartments on the ground floor were available at the time.
An adjudicator appointed by the commission investigated and found no data to suggest that all children are likely to make noise, and no evidence to support the company’s safety concerns.
The management firm has also been ordered to pay the cash damages to Hiebert and remove the restriction from its lease agreement at the Amberwood Village apartments.
Dianna Scarth, the commission’s executive director, says the agency has just published guidelines on human rights and housing-related issues, which are designed to assist landlords and tenants.
